Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and itsNOTaLawyer ("we", "us", "our", the "Service"). By accessing or using the Service in any way — including browsing, asking a question, or creating an account — you agree to these Terms in full. If you do not agree, you must not use the Service.

2. The Service is NOT legal advice

itsNOTaLawyer provides general legal information for educational purposes only. We are not a law firm, not a lawyer, and not your lawyer. Nothing on the Service — including AI-generated answers, library articles, examples, templates, or communications with us — constitutes legal advice, a legal opinion, a solicitation, or legal representation.

Use of the Service does not create an attorney-client relationship, fiduciary relationship, or any other professional relationship between you and us. Communications through the Service are not protected by attorney-client privilegeand may not be confidential.

For advice about your specific situation, you must consult a licensed attorney in your jurisdiction. Laws vary by location and change over time; information on the Service may be incomplete, out of date, incorrect, or inapplicable to your circumstances.

3. Eligibility and acceptable use

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. You agree not to:

  • use the Service to plan, commit, or facilitate any unlawful act;
  • request or generate content that helps evade lawful obligations or harm others;
  • misrepresent the AI's output as legal advice from a licensed attorney;
  • scrape, reverse engineer, or abuse the Service or its underlying models;
  • upload personal data of third parties without their consent;
  • use the Service to provide legal services to others.

4. Accounts and payments

The free tier is anonymous. Paid features (one-time access passes and recurring subscriptions) require an account. You are responsible for the security of your account credentials and for all activity under your account. Prices and subscription terms are shown at checkout and may change for future purchases. Payments are processed by Paddle.com (Paddle.com Market Limited), which acts as the Merchant of Record for all purchases.

4a. Refund policy

You may request a full refund within 14 days of purchase for any unused subscription period or unused access pass. "Unused" means you have not asked any AI questions on that paid plan since the purchase. Requests must be sent through our contact page. Refunds are processed by Paddle back to your original payment method, typically within 5–10 business days. After 14 days, or if the plan has been used, refunds are at our sole discretion.

5. AI output

AI responses are generated automatically and may be wrong, biased, outdated, or fabricated (including invented statutes, cases, or numbers). You are solely responsible for verifying any information before relying on it. We do not guarantee accuracy, completeness, currency, or fitness for any purpose.

6. Intellectual property

The Service, its content, design, and software are owned by us or our licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

7. Third-party services and ads

The Service uses third-party providers (including AI model providers, hosting, payment processors, and Google AdSense). Their terms and privacy practices apply to your interactions with them. We are not responsible for third-party content or services.

8. Disclaimers — no warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THAT ANY INFORMATION PROVIDED IS LEGALLY CORRECT OR APPLICABLE TO YOUR SITUATION.

9. Limitation of liability — no liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL itsNOTaLawyer, ITS OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, LIBERTY, OR LEGAL RIGHTS, ARISING OUT OF OR RELATING TO YOUR USE OF — OR INABILITY TO USE — THE SERVICE OR ANY INFORMATION OBTAINED THROUGH IT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) US$50.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the smallest extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless itsNOTaLawyer and its owners, operators, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any action you take or fail to take based on information from the Service.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including suspected violation of these Terms. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.

12. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Material changes will be reflected by updating the "Last updated" date above. Your continued use after changes take effect constitutes acceptance of the revised Terms.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to conflict-of-law rules. You agree that any dispute will be resolved exclusively in the competent courts of that jurisdiction, and you waive any objection to venue. To the extent permitted by law, you waive any right to a jury trial and to participate in any class action against us.

14. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and us regarding the Service.
